Absence Management

Particular focus on:-

Advising employers on all aspects of absence management including:- 

• The correct procedure to follow for both short and long term absences;
• When to obtain medical evidence, and drafting appropriate referral letters;
• Liaising with occupational health;
• Implications of the Disability Discrimination Act, including whether an employee is disabled, what amounts to discrimination, reasonable adjustments, and when it is appropriate to dismiss;
• Avoiding unfair dismissal claims;
• Dealing with PHI claims and claims for ill health early retirement;
• Employees who “go sick” during disciplinary proceedings; and
• Drafting absence management policies and procedures.

We work with employers of all sizes as well as with employees. 

Projects for the service worked on:- 

We have worked with a number of employers, including large Plc’s, to reduce absence levels, including training managers, drafting policies and procedures, and dealing specifically with a number of employees on long term absences.

 

We have also successfully defended employers on numerous occasions in cases of unfair dismissal, many of which have also dealt with difficult issues under the Disability Discrimination Act.
