Insolvency Litigation

The Corporate Insolvency Team provide advice and conduct proceedings for insolvency practitioners as office holders in liquidations administrations, administrative receiverships and as supervisors of company voluntary arrangements. We also assist our clients to secure out of Court and in Court appointments and to provide advice during the appointment (liaising with our non-contentious insolvency team as necessary) on all issues. 

We are able to advise on disputes in respect of recovery of money and assets from former directors, third parties and debtors including preference claims, wrongful and fraudulent trading, misfeasance and directors disqualification. We are able to assist in making post insolvency applications to the Court for permission or directions. 

We maintain an efficient case manage computerise debt recovery system to assist office holders with recovery of book debts.

We are able to assist clients in reaching the earliest possible settlement of any claims if possible without Court proceedings and when proceedings are necessary we are able to accept instructions on a conditional fee basis.

Personal Bankruptcy

The Personal Bankruptcy Team provide advice and conduct proceedings for insolvency practitioners as office holders including as trustees in bankruptcy and supervisors of voluntary arrangements. 

We conduct all forms of insolvency proceedings to recover property money and assets and we advise on the recovery of preservation and ownership of assets to obtain costs effective results for our clients both by way of negotiation, mediation and where necessary appropriate proceedings. 

We have considerable experience of assessing the merits of any claims and are happy to consider various funding arrangements including acting on a conditional fee basis.

We also balance our experience to office holders by acting for bankrupts, and former bankrupts who face potential claims and are involved in proceedings by office holders. We appreciate the need to reach a settlement as quickly as possible to avoid substantial costs being incurred and we are able to assist in examinations, possession claim, and bankruptcy annulments on behalf of individuals.
